Terms of use

1. Purpose

These terms of use (the "Terms") govern access to and use of the LibertiChat online chat service, available at libertichat.com. Any use of the service implies full and unreserved acceptance of these Terms.

2. Access to the service

The service is available free of charge. It may be used in guest mode with a simple nickname, or via a free account allowing you to reserve your nickname.

The publisher reserves the right to modify, suspend or discontinue all or part of the service, at any time and without notice, in particular for maintenance or security reasons.

3. Minimum age

Access to the service is reserved for persons aged at least 18. By using LibertiChat, you declare that you meet this condition. Any account that appears to be held by a minor will be deleted.

4. User account

• You are solely responsible for the confidentiality of your password and for any activity carried out from your account.
• A nickname must not impersonate a third party, nor imitate that of a moderator or of the site administration.
• Creating multiple accounts in order to circumvent a sanction is prohibited.
• You may request the deletion of your account at any time.

5. Rules of conduct

When using the service, it is strictly prohibited to:

• distribute content of a child pornographic nature, or involving minors in any way whatsoever;
• make racist, antisemitic, xenophobic, homophobic or sexist remarks, or remarks inciting hatred, violence or discrimination;
• harass, threaten, intimidate or insult another user;
• distribute violent, degrading content, or content that undermines human dignity;
• display sexual content in a room that does not provide for it, or in front of participants who have not consented to it;
• record, capture or rebroadcast another user's video or audio streams without their explicit consent;
• publish the personal data of a third party ("doxxing");
• engage in advertising, spam, solicitation, or promote competing services;
• distribute viruses, malicious links or any harmful content;
• attempt to fraudulently access the service, disrupt it, circumvent its protections or overload its infrastructure;
• use bots, automated scripts or any artificial means of interaction;
• infringe the intellectual property rights of third parties, in particular by broadcasting protected music or videos without authorization.

6. Moderation and sanctions

The publisher and the moderators may intervene at any time to enforce these Terms. Depending on the seriousness of the facts, the following measures may be taken, without notice or prior justification:

1. Warning;
2. Temporary exclusion from a room or from the service;
3. Permanent exclusion and deletion of the account;
4. Technical blocking of access in the event of repeat offences or circumvention.

The most serious offences — in particular those involving minors — are subject to a report to the competent authorities, accompanied by the technical elements enabling the identification of their author.

7. Rooms created by users

Any user may create a room and moderate it. The creator of a room is responsible for the atmosphere they maintain there and must ensure compliance with these Terms. A room manifestly used to circumvent these rules will be closed.

8. User content

You remain the owner of the content you publish. You warrant that you hold the rights necessary for this content and that you are solely responsible for its distribution.

LibertiChat acts as a host within the meaning of article 6-I-2 of the French LCEN (Digital Economy Act): the publisher does not exercise any prior control over exchanges, but promptly removes any manifestly unlawful content brought to its attention.

9. Liability

The service is provided "as is", without any guarantee of continuous availability or of freedom from error. The publisher cannot be held liable for:

• the remarks, behaviour or content distributed by users;
• service interruptions, data losses or technical malfunctions;
• the consequences of meetings or exchanges initiated through the service;
• any use of the service that does not comply with these Terms.

10. Safety advice

Never share your personal details, banking information or identity documents with another user. Beware of requests for money and of webcam blackmail attempts. In the event of suspicious behaviour, leave the room and report it.

11. Changes to the Terms

These Terms may be modified at any time. The applicable version is the one published on this page, whose update date appears at the top of the document. Continued use of the service constitutes acceptance of the version in force.

12. Applicable law

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts shall have sole jurisdiction.
